Barry Crux and Company are now able to produce Energy Performance Certificates for Commercial Property
Since the beginning of 2009, EPC's have been mandatory on the first sale or letting of the vast majority of commercial property. As an additional service to clients, Barry Crux and Company are now able to generate and lodge the documents required by law when a "non-domestic" property is marketed.
The responsibility for making an EPC and RR available falls fairly and squarely on the owner and landlord/sub landlord. The regulations also apply in the sale of a business where either the sale of an existing lease forms part of the transaction, or where a new lease is granted to the purchaser of the business.
Whilst it is "good practice" for agents to prompt their clients to commission Energy Performance Certificates on non-domestic property at the appropriate time, unlike residential EPCs the agent is not the party legally responsible. An owner/landlord may risk a substantial fine if the regulations which are enforced by the local Trading Standards Department, are not adhered to.
The EPC regulations are both complex and confusing so it is vital to get the best advice as quickly as possible.
